Rules and conditions of LADRAN GAUCHO draws

1. Identification of the promotion organizer

 This raffle is organized by the companyLADRAN GAUCHO UBRIQUE LIMITED COMPANY (onwards,LADRAN GAUCHO UBRIQUE SL), with CIF: B93954402 and address for notification purposes at Avda. Fernando Quiñones 7, 3H. 11600 Ubrique (Cádiz); with contact telephone number: 623 43 86 55 and email:info@ladrangaucho.com.

2. Promotion objectives

LADRAN GAUCHO UBRIQUE SL, will carry out the draws (hereinafter, the PROMOTIONS) and which will take place on the Instagram account of@ladrangauchoor in the collaborator profile, in accordance with the provisions of these bases.

3. Territorial and temporal scope of the promotion

3.1. The PROMOTIONS will take place within the Spanish State, only Spain Peninsula.

3.2. The promotional period is set in each of the posts made.

4. Requirements and ways to participate

4.1. Be a natural person over 18 years of age, resident in Spain.

4.2. Participate in the contest through the participant's real, active and personal account opened on Instagram, and which cannot be considered likely to have been created with the sole intention of participating in the PROMOTION.
Only those accounts that meet the following characteristics will be considered valid for participation:

• The user must have a profile photo designated by them (it is not mandatory that it be a personal photo).
• You must have at least one photograph/post published on your profile from the moment of its creation.
  It will be understood that the account has been created with the sole intention of participating in the promotion when it has been opened after the publication of the promotion and does not meet the stated requirements.

4.3. It will be necessary to comply with the requirements indicated in each of the promotions.

4.4. Each participant may participate as many times as they want, from a single account or profile or from several, as long as they meet the requirements set forth above regarding the conditions of account validity.

5. Free

Participation in the PROMOTION isFREE.

6. Promotion prizes

6.1. The winner who, according to the participation criteria, and once the duration of the draw has ended, is the winner(s), will have the right to receive the prize indicated in the publication.

6.2. The draw will be carried out through an application intended for this purpose.

6.3. The prize obtained, if applicable, will not be exchangeable or redeemable for another cash value or for another alternative prize.

LADRAN GAUCHO UBRIQUE SLwill be responsible for the shipping costs only once to the address indicated by the winner in the terms expressed in base 7.

6.4. Participation in the draw implies acceptance and submission to the terms of participation included in these legal bases of the participant, without being able to ignore what is provided here.

7. Communication of the winners

7.1. The winner will be informed directly via Instagram direct message, within SEVEN (7) business days (Monday to Friday) after the end date of the draw.
Once the communication indicated in the previous section has been made, the winner must respond in the same way within a maximum period of TWO (2) business days (Monday to Friday) after the date of sending said communication, stating the following:

• whatexpressly accepts the communicated prize and the terms and conditions for its deliveryprovided for in these bases.
  NON-acceptance of the prize and the terms and conditions for delivery of the prizeis equivalent to your RESIGNATION. When this point is not stated in the response message,LADRAN GAUCHO UBRIQUE SLmay require the awarded person to make a statement on this matter within the period indicated above.
• For the purposes provided for in Condition 9 of these rules, you must provide a photograph in which only the winner appears and that complies with the terms and conditions of Instagram publication for publication; or, otherwise, expressly authorizeLADRAN GAUCHO UBRIQUE SLto make use of the photograph that appears in your profile, under the terms set forth in these rules.
  Failure to comply with this requirement will result in the forfeiture of the prize won and exclusion from the draw. When this point is not stated in the response message,LADRAN GAUCHO UBRIQUE SLmay require the awarded person to make a statement on this matter within the period indicated above.
• Provide a copy of your national identity document (DNI) or comparable title for foreigners residing in Spain, in order to obtain the following personal data: Name and surname, DNI and age.
• Provide an address in the territory of the Spanish State (Peninsula, Ceuta, Melilla, Balearic Islands and Canary Islands) to which to send the prize; a contact email and mobile phone number.
  If within the indicated period the awarded person or, where applicable, substitute, does not respond to the communication made byLADRAN GAUCHO UBRIQUE SL, it will be understood that the draw is abandoned, passing the prize to the next substitute on the draw list.

7.2. In the event that one or more prizes are not accepted and it is deemed withdrawn until the number of substitutes has been exhausted, the prize in question will be declared void, leavingLADRAN GAUCHO UBRIQUE SLexonerated from any obligation or responsibility.

8. Reservations and limitations

8.1. LADRAN GAUCHO UBRIQUE SLis exonerated from all responsibility in the event of malfunction of the electronic communication networks that prevent the normal development of the promotion for reasons beyond its control and especially due to external acts of bad faith.

8.2. Any abusive or fraudulent use by users will lead to the subsequent disqualification of the participant in the PROMOTION. If such misuse of the application (with or without the intention of fraud) causes it to malfunction,LADRAN GAUCHO UBRIQUE SLwill be exonerated from all responsibility, and may cancel the promotion.

8.3. Likewise, it will be understood, by way of example, but not limited to, that abuse or fraud occurs when a participant participates in the promotion using a false account or third-party identities without their consent.

8.4. LADRAN GAUCHO UBRIQUE SLThey are not responsible for possible losses, deterioration, delays or any other circumstance attributable to third parties that could affect participation in this PROMOTION.

8.5. LADRAN GAUCHO UBRIQUE SLis not responsible for possible inappropriate or offensive content that users may upload at their own risk.

8.6. The verification of any of these circumstances during the PROMOTION will result in automatic disqualification and prohibition from participating in the contest, as well as the loss of the prize if it has been awarded.

8.7. LADRAN GAUCHO UBRIQUE SLis exempt from any responsibility in the event of any error in the data provided by the participants themselves that prevents their identification.

8.8. The awarding of the Prize ispersonal and non-transferable.

The prizes are subject to these legal bases and it will not be possible to replace them totally or partially with cash. The prizes will not be subject to change, alteration or compensation at the request of the winners.

If the prize is rejected by the winner, no alternative will be offered. Their sale or disposal is strictly prohibited.

8.9. The indication of the winners' personal data will be mandatory for the management of the Prize. Any false communication of personal data will give the organizers of this draw the right to disqualify the winner and be able to have the corresponding prize, in the terms expressed here.

8.10. LADRAN GAUCHO UBRIQUE SLreserves the right to make changes that result in the successful completion of the DRAW when there is a just cause or reasons of force majeure that prevent it from being completed in the manner set out in these rules.

8.11. That Instagram is totally exonerated from any liability arising from this giveaway on the part of each participant.

8.12. The winner is responsible for collecting any permission or consent necessary to enjoy the prize and any incident that occurs during the prize.

Likewise,LADRAN GAUCHO UBRIQUE SL will not be responsible for damages, both personal and property., that the winners suffer due to the enjoyment of the prize awarded, including compensation of any nature and/or nature, expenses, costs (with express inclusion of the fees of lawyers and attorneys).

8.13. LADRAN GAUCHO UBRIQUE SLis expressly authorized to postpone, shorten, extend, modify, cancel or suspend the draw as a result of force majeure beyond its control, undertaking to inform the participants of this circumstance as soon as possible.

8.14. LADRAN GAUCHO UBRIQUE SLis exempt from any liability in the event of providing personal data, as well as name, personal or banking data, to fraudulent accounts outside of@ladrangaucho.

Likewise,LADRAN GAUCHO UBRIQUE SLis expressly empowered to resolve any contingency not provided for in these legal bases as long as it does not entail a substantial change to the terms and conditions of the draw or means a reduction in the rights of consumers and users or non-compliance with regulations regarding the protection of personal data.

9. Transfer of image rights and/or intellectual property of the winner

9.1. Acceptance of the prize, in the terms expressed in Condition 7.1., will entail theAUTHORIZATIONtoLADRAN GAUCHO UBRIQUE SLby the awarded person to reproduce, use and disseminate theirusername, youraccountand hisprofile photoor that provided by it, in any advertising and/or promotional activity that is related to this PROMOTION, all in any medium (including, but not limited to, exploitation through the Internet and RRSS) without said activities conferring the right to remuneration or any benefit, without prejudice to the delivery of the prize obtained in accordance with these bases.

9.2. The lack of authorization referred to in Condition 9.1 will result in the renunciation of the prize won and exclusion from the draw, proceeding in accordance with the provisions of Condition 7.1.

10. Processing of personal data

10.1. The personal information provided by the participants and winners will be treated in accordance with the principles of confidentiality and in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of their personal data and the free circulation of these data and which repeals Directive 95/46/EC (General Data Protection Regulation) and Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights.

LADRAN GAUCHO UBRIQUE SLwill be responsible for the processing of said information. For these purposes, it will be incorporated into the Registry of Treatment Activities owned byLADRAN GAUCHO UBRIQUE SLfor its treatment, which will consist of participation in this draw, as well as to contact the winners and substitutes of the draw.

10.2. Terms of use of personal data: 

Purpose of the processing of personal data.The collection and processing of personal data has the following purpose:

• Manage the PROMOTION regulated in these bases.
• The delivery and acceptance of the prize by the participants and winners.
• Sending the prize packs.

The personal data collected and processed are the data necessary for sending the packs and delivering the raffled prizes: name / surname / full home address / email / telephone number.

Data retention:The data controller will only retain the data when it is necessary to carry out follow-up actions of the act, taking into account the purpose of the processing of personal data.

The user may exercise therights of access, rectification, deletion and other rights that can be consulted in the additional informationand detailed in our privacy policy by contacting the person responsible for the treatment at the indicated email.

11. Acceptance of bases

11.1. Without prejudice to the provisions of Condition 8 and the rest of the conditions included in these rules, participation in the promotion implies theexpress and unreserved acceptanceof these bases.

11.2. Failure to comply with any of these bases by the participant will determine his or her immediate disqualification from the draw, without him/her being eligible to participate in the PROMOTION by any other means.

12. Applicable law and jurisdiction

12.1. These Promotion Rules are governed by Spanish Legislation. The Courts and Tribunals of the city of Seville will be competent to resolve any claim or controversy that may arise in relation to the validity, interpretation or compliance with these bases.

12.2. If any clause or part of a clause of these bases is declared void, illegal or not applicable, said clause or part of it will be understood as not included in these bases, without affecting the validity, legality or applicability of the rest of the conditions included in them.
